E-Verify

Effective September 8, 2009, the Department of Homeland Security (DHS) mandated that employers awarded federal contracts or subcontracts containing the E-Verify clause must participate in the E-Verify program. E-Verify is an internet-based system that enables employers to confirm an employee’s eligibility to work in the United States by electronically comparing information from the employee's Form I-9 with records available through DHS and the Social Security Administration.

Under this federal rule, covered contractors are required to:

  • Enroll in the E-Verify system
  • Verify employment authorization for all new hires
  • Re-verify current employees assigned to federal contracts containing the E-Verify clause

As a participating employer, Michigan State University (MSU) must comply with E-Verify requirements by:

  • Verifying new employees assigned to covered federal contracts within three business days of their start date
  • Verifying existing employees assigned to covered federal contracts within thirty calendar days of being assigned to a qualifying federal contract

MSU's continued compliance with the E-Verify law is essential to maintaining federal contracting eligibility.

 

Department Instructions for E-Verify Compliance

All current and future employees whose positions are funded by contracts containing the E-Verify clause must be processed through the E-Verify system.

Please note:

  • Human Resources can only identify employees subject to E-Verify after payroll cost redistributions are complete in the HR system.
  • It is the department’s responsibility to proactively verify whether a position is funded by a qualifying contract and to ensure all necessary documentation is submitted in a timely manner.

Action Required by Department Administrators:

  • Ensure a new Form I-9 is completed for each applicable employee
  • Submit all required attachments in accordance with federal regulations
  • Complete these steps before the deadlines outlined in the Federal Code of Regulations to maintain compliance

FAQ

No. Any employee that is E-Verified by MSU, only needs to be E-verified once, even if they changed their resident status. 

No. If an employee is E-Verified in another department/unit/ MAU, a new E-Verify is not required even if they change positions/departments/MAUs. 

No. Even if a one day break in service occurs as a result of the change in employee type, the E-Verify is still attached to their record.
